[11:59] Second Life: abrahamjacobs2 gave you Magistrate , Advocate TOOLS FOR INVESTIGATIONS..
[12:02] ꝀȺɌ (karisima.stein): Evidence is needed
[12:03] レаяа (larabones) is online.
[12:03] Abraham Jacobson (abrahamjacobs2) entered chat range (19.08 m).
[12:04] Abraham Jacobson (abrahamjacobs2): We need A crime, a victim, a witness or evidence and an accused culprit or perpetrator
[12:04] Abraham Jacobson (abrahamjacobs2): Do we *actually* need a culprit or perpetrator at the outset, though? Would it not be enough to have a crime, victim and witness/evidence/both?
○ That is how we start, but if there is no perpetrator, there couldn't be a crime
[12:04] Abraham Jacobson (abrahamjacobs2): ◘ a crime is necessitated only by a law being violated. Documentation, or awareness, of that crime is necessitated by evidence/ witnesses. The perpetrator is only required for delivery of justice
[12:05] Abraham Jacobson (abrahamjacobs2): ○ Yes, but even if we know a crime has been committed without a suspect we can't put anyone on trial.
[12:05] Abraham Jacobson (abrahamjacobs2): that happened to me three times in my last city
[12:05] Abraham Jacobson (abrahamjacobs2): I keep getting cases where the suspect left the city
[12:05] Vulcan Arian (lordmarshall) is offline.
[12:05] Davor O'Donnell (davoroflaura): sighs
[12:06] Abraham Jacobson (abrahamjacobs2): could not put anyone on trial or deal with it
[12:06] Abraham Jacobson (abrahamjacobs2): ◘ We do not know who that is but we know someone did commit the crime... It is up to us to figure out the who I would think.
[12:09] Abraham Jacobson (abrahamjacobs2): ◘ There are MANY victimless crimes in Gor. For example, if I didn't wear a veil in the wrong city and was collared, who was the victim?
[12:09] Abraham Jacobson (abrahamjacobs2): Truly, it was me for losing my freedom as punishment for a crime in which nobody was harmed. So very many, many laws against free women are victimless crimes, in which the is no body being hurt by her actions, but she is punished anyway
[12:10] Abraham Jacobson (abrahamjacobs2): the laws are not about victims, but about CONTROL of women
[12:10] Abraham Jacobson (abrahamjacobs2): Back to the mushroom question
[12:11] Phoebe Thiessam is online.
[12:11] Abraham Jacobson (abrahamjacobs2): The answer is no, unless the laws say that all mushrooms belong to the village
[12:11] Abraham Jacobson (abrahamjacobs2): ◘ It would be a crime against mushroom farmers who rely on the crops for their income. But as you said, it's outside the walls ... sooooo ... city laws don't apply do merchant Laws?
[12:11] Kai (vaxxar) is offline.
[12:11] Madeleine Paxson (mallairian) is offline.
[12:11] Abraham Jacobson (abrahamjacobs2): Ah, the laws of the city are generally only enforced within their walls ;)
[12:11] Abraham Jacobson (abrahamjacobs2): THE WITNESS OR EVIDENCE
[12:12] Abraham Jacobson (abrahamjacobs2): Without a witness or evidence there is no way to prove who committed the crime and sometimes that a crime was even committed. If the crime is not seen being committed, sometimes the result of a crime are discovered and can start an investigation. And example would be finding a body laying in the inn with no one around.
[12:12] Sara Valgard (alluring.waggletail) is offline.
[12:12] Madeleine Paxson (mallairian) is online.
[12:12] Catherine Aurora Gallius (babygirlsherri) is online.
[12:12] Abraham Jacobson (abrahamjacobs2): ◘ A trial based on documents would also be conceivable. Then the documents would speak as witnesses. For example manumission papers, or sales receipts
○ Well those would definitely be evidence, but you would still need a crime
[12:12] Ella De Wren Bade (elladewren) is online.
[12:12] Abraham Jacobson (abrahamjacobs2): ◘ As well as the science a good forensic study is a fun rp to do in a collaborative way with the other castes. You can include your physicians, the red caste to do some random questioning.. Use the people around you.
[12:13] Abraham Jacobson (abrahamjacobs2): Magistrates need to maintain good relationships with both of those castes
[12:13] Abraham Jacobson (abrahamjacobs2): THE ACCUSED
[12:13] Abraham Jacobson (abrahamjacobs2): Also known as the suspect, perpetrator, culprit etc... The one who allegedly committed the crime. Even if we know a crime has been committed without a suspect we can't put anyone on trial.
[12:13] zCS # [Mod] Llewellas Resident [RP] logged into the region.
[12:14] Abraham Jacobson (abrahamjacobs2): On patrols Warriors find picked doors. OOCly we can see who picked that door, but without seeing the person do it we have no IC evidence or witness. And all evidence has to found IC ly.
[12:14] Abraham Jacobson (abrahamjacobs2): In cases like this, unless that person walks up and confesses there is little you can do but file a report and go about your business. If the person is foolish enough to confess..... There is your evidence.
[12:14] Abraham Jacobson (abrahamjacobs2): But you just sit on the bench and oversee trials right? Wrong, and if that is all you want to do, you may want to consider a different line of work.
[12:15] Abraham Jacobson (abrahamjacobs2): Here you may not only need to do some investigating but may want to to ensure you get good information and all the facts.
[12:15] Melody of Koroba (melody.tarber) is offline.
[12:15] Abraham Jacobson (abrahamjacobs2): Ideally your Warriors would conduct a full investigation, gather evidence, witness lists and statements. This information would be passed on to a city Advocate This is SL Gor though, and ideally just doesn't happen.
[12:15] Abraham Jacobson (abrahamjacobs2): Most of the time information on prisoners will come from your Warriors. It is important for you to keep a good relationship with them, even if you occasionally have a difference of opinion. Your Warriors are the ones that will enforce your warrants and you want to make sure you are all working on the same side.
[12:15] Melody of Koroba (melody.tarber) is online.
[12:16] Abraham Jacobson (abrahamjacobs2): that may be difficult warriors and Magistrates do not have time together
[12:17] Abraham Jacobson (abrahamjacobs2): So, do rp with them on a regular basis and do not ignore them
[12:17] BB Arliss (busybee.ashbourne) is offline.
[12:17] Freya Hedwig (sparklingjewelri) is online.
[12:17] Abraham Jacobson (abrahamjacobs2): Ok, moving on to crime scenes. Lets say you get called to the scene of a dead body, what is your priority?
[12:17] Davor O'Donnell (davoroflaura): secure evidence
[12:17] Abraham Jacobson (abrahamjacobs2): ◘ Secure the area, look for clues while is still fresh. If possible, get a coroner to ascertain when the person die, to establish time of death.
[12:18] Abraham Jacobson (abrahamjacobs2): Now if you didn't get to the scene right away many of the people there just passed by and joined the growing crowd. Crime scenes can be exciting and a great place for gossip. In your interviews you need to separate passers by from witnesses.
[12:18] Lađγ Lïv Thε Hσŋεγ Mεŗcɧanŧ (cherry.rabbit) is offline.
[12:19] Abraham Jacobson (abrahamjacobs2): I did not get to a scene right away, by the time i found out about it, most of the key people stated scattering. Lost two days tracking them down
[12:19] Abraham Jacobson (abrahamjacobs2): Make a list!!! create a folder for this crime.
[12:20] Abraham Jacobson (abrahamjacobs2): Open a NC and make a list of what you saw, who you spoke with, what they said, any evidence, potential witnesses, potential suspects, EVERYTHING even if it doesn't seem important. Being able to look back over this information is invaluable.
[12:20] Abraham Jacobson (abrahamjacobs2): I gave you the forms that may come in handy
[12:20] Abraham Jacobson (abrahamjacobs2): a guy that told you he was in the tavern and just happened by the crowd to watch? What about the woman that said she saw that same man lurking around the side of the building?
[12:21] Abraham Jacobson (abrahamjacobs2): There was a man hidding behind a building , i saw him in my viewer but could not figure out how to get to him without godmodding
[12:22] Abraham Jacobson (abrahamjacobs2): He has a theif label and was flipping a coin
[12:22] Abraham Jacobson (abrahamjacobs2): I love larger cites, but with them, crime comes
[12:23] Abraham Jacobson (abrahamjacobs2): we arrested a person a week at least
[12:23] Abraham Jacobson (abrahamjacobs2): Write it all down and cross reference your statements. All it takes is one time to make a connection and you will be glad you did.
[12:24] Abraham Jacobson (abrahamjacobs2): ◘ This happened last year.to a magistrate last year , he came across a crime taking place, and became an important witness later on ... a rarius vandalizing an inn and assaulting the innkeeper. Can I still participate in the investigation in any way, or should I be totally separate from it?
[12:24] Abraham Jacobson (abrahamjacobs2): IDEAS?
[12:25] ꝀȺɌ (karisima.stein): Magistrate is a witness.. May need to testify
[12:25] ꝀȺɌ (karisima.stein): Another Magistrate takes the case
[12:25] Abraham Jacobson (abrahamjacobs2): yes
[12:25] Davor O'Donnell (davoroflaura): nods
[12:25] Abraham Jacobson (abrahamjacobs2): That would create a conflict of interest, I believe, as you are a witness to the case. You could give your statement, but someone else would have to do the investigation to keep objectivity.
[12:25] Drew Barnard nods
[12:26] Abraham Jacobson (abrahamjacobs2): this goes back to my Magistrate code of conduct i handed out yesterday
[12:26] Abraham Jacobson (abrahamjacobs2): There are times where you should be removed from a cast, the city needs to trust our judgement
[12:26] Abraham Jacobson (abrahamjacobs2): Fortunately for us this is Gor. Have a suspect that doesn't want to talk? Torture. Have a witness that doesn't want to cooperate? Torture. This is a tool that we can use, and it can be an effective one.
[12:27] ƊάƓƓƐƦ (kail.lefevre) is online.
[12:27] Abraham Jacobson (abrahamjacobs2): Speaking of torture.... We all know that the testimony of slaves is taken by torture right? Well this SHOULD be at the discretion of the court. And, in my opinion, this should be for TESTIMONY, testimony given in court against a free person.
[12:27] Abraham Jacobson (abrahamjacobs2): This should not mean that if a slave makes a statement or can identify someone they need to be tortured in order to do so. Use the information to catch the suspect and prepare testimony as you need later. Why take the time to torture a slave if there is a free that can tell you the same thing when they log on this evening?
[12:28] Abraham Jacobson (abrahamjacobs2): Fortunately for us this is Gor. Have a suspect that doesn't want to talk? Torture. Have a witness that doesn't want to cooperate? Torture. This is a tool that we can use, and it can be an effective one.
[12:28] Abraham Jacobson (abrahamjacobs2): ah nuts
[12:28] Abraham Jacobson (abrahamjacobs2): I am sick so grabbed the wrong quote
[12:29] Abraham Jacobson (abrahamjacobs2): Keep your interviews brief and stick to key questions. Get their name, home and caste. Ask when they came, what they saw, who they saw. Did they hear anything? Do they know the victim? Did they have legitimate reason to be there?
[12:29] Abraham Jacobson (abrahamjacobs2): If you have OOC knowledge you MUST figure out a way to get the information ICly. Make it in to RP, no metagaming to make a case. It should be easy to find what you need when you know what you're trying to find.
[12:30] Abraham Jacobson (abrahamjacobs2): This goes back to the paper i gave you called defense
[12:30] Abraham Jacobson (abrahamjacobs2): use it to sort you information
[12:31] Abraham Jacobson (abrahamjacobs2): Remember if you do go to court , the prosection has to go first, so you statement needs to be written out before going into court
[12:31] Abraham Jacobson (abrahamjacobs2): Once you've finished your interviews and investigation you need to sort through and find what's pertinent to your case. You probably won't need every person that was there as a witness. Find the people that saw, knew or heard something, put them on a list and when you have a trial date set tell them to show. This is Gor, if they don't want to come send your Warriors to drag their arse to the courthouse.
[12:31] Abraham Jacobson (abrahamjacobs2): We need to act like its Gor
[12:32] Abraham Jacobson (abrahamjacobs2): Not some law and order show
[12:32] Abraham Jacobson (abrahamjacobs2): There is no ten days for contempt of court sentence here. Refuse to cooperate and I will see you stripped of wealth and possessions, collared, banished, impaled or whatever else I feel like doing to you.
[12:32] Abraham Jacobson (abrahamjacobs2): Now that is entertainment
[12:33] Abraham Jacobson (abrahamjacobs2): I gave you all forms called Introduction to legal forms to show how the paperwork would normally flow
[12:34] Abraham Jacobson (abrahamjacobs2): I hope that helps
[12:34] Abraham Jacobson (abrahamjacobs2): Questions?
[12:35] Abraham Jacobson (abrahamjacobs2): You stall have time to go watch the dancers. If you will forgive me i am going back to bed
[12:35] Abraham Jacobson (abrahamjacobs2): still
[12:36] ꝀȺɌ (karisima.stein): Isn't there another lecture?
[12:36] Abraham Jacobson (abrahamjacobs2): tools for being an embassidor is 30 min
[12:36] Abraham Jacobson (abrahamjacobs2): from now
[12:36] Kati Evans: Who has that one?
[12:37] Abraham Jacobson (abrahamjacobs2): If you all want to stay for that, i will stay
[12:37] Abraham Jacobson (abrahamjacobs2): me
[12:37] Abraham Jacobson (abrahamjacobs2): I teach it
[12:37] Abraham Jacobson (abrahamjacobs2): So i am here and at your service
[12:38] Abraham Jacobson (abrahamjacobs2) takes more tonic
[12:38] ꝀȺɌ (karisima.stein): If all agree, You need to rest.
[12:38] ꝀȺɌ (karisima.stein): Meds, fluids and rest
